Terms of Service
Please read these Terms of Service carefully before using cuberout. By using the Telegram bot, creating an API key, topping up a balance, or making API requests through the service, you agree to these Terms.
1. Service Description
cuberout is a prepaid LLM API proxy with a Telegram bot. It provides API-key authentication, prepaid wallet billing, model catalog access, rate limiting, request forwarding, and usage accounting for OpenAI-compatible and Anthropic-compatible API surfaces.
cuberout acts as an intermediary access and billing layer. The underlying AI models and upstream routing services are operated by third parties. cuberout does not own those models and does not guarantee their availability, output quality, pricing stability, latency, or continued operation.
2. Account Registration
Accounts are created through Telegram. You are responsible for maintaining access to the Telegram account associated with your cuberout account and for keeping your account information accurate.
cuberout may use your Telegram identifier and username to create your account, display balances, manage API keys, process support requests, and associate top-ups with the correct wallet.
3. API Keys and Account Responsibility
API keys are issued to your account and are shown only once when created. You are solely responsible for keeping API keys confidential and for all activity performed with your keys.
Do not share keys publicly, embed them in client-side code, publish them in repositories, or transfer them to unauthorized users. If you believe a key has been exposed, revoke it and create a new one immediately.
4. Prepaid Balance, Holds, and Billing
cuberout operates on a prepaid wallet balance denominated internally in microUSD. Before an API request is sent upstream, cuberout may reserve a hold based on estimated request cost, configured model prices, image generation prices, token estimates, and a safety multiplier.
After a successful request, cuberout finalizes the charge using available upstream usage information where possible. If final usage is unavailable, cuberout may use a reasonable estimate. Unused hold amounts are released back to your available balance. Failed upstream requests are generally refunded or released unless abuse, fraud, or another exceptional condition applies.
Pricing, model availability, minimum holds, safety multipliers, and rate limits may change over time. Your continued use of the service after published changes means you accept the updated pricing and limits.
5. Top-Ups and Payments
Top-ups may be processed manually by an administrator or through supported third-party payment services. Payment providers may have their own terms, fees, policies, fraud checks, and data handling practices.
When topping up by bank transfer or payment provider, you must follow the payment instructions exactly. Incorrect comments, insufficient amounts, reversed payments, chargebacks, duplicate events, provider errors, or unsupported currencies may delay or prevent crediting.
Unless required by applicable law or explicitly approved by cuberout, prepaid credits are not refundable, transferable, or redeemable for cash. If a payment is reversed, disputed, fraudulent, or credited by mistake, cuberout may deduct the corresponding amount, suspend access, or request repayment.
6. Usage Limits and Availability
The service may enforce request-per-minute, token-per-minute, image-per-minute, concurrent request, body size, wallet balance, and stream duration limits. Requests that exceed active limits may return an error such as HTTP 429.
cuberout is provided on a best-effort basis. Scheduled maintenance, upstream provider outages, model deprecations, network failures, payment provider issues, or operational incidents may interrupt service. No uptime or service level commitment is guaranteed unless a separate written agreement says so.
7. Acceptable Use
You agree not to use cuberout to:
- Violate applicable law or third-party rights.
- Generate, distribute, or facilitate illegal, harmful, or abusive content.
- Attempt to bypass authentication, billing, quotas, holds, or rate limits.
- Probe, disrupt, overload, scrape, reverse engineer, or abuse the service.
- Resell, sublicense, or redistribute API access without written permission.
- Use stolen payment methods, fraudulent transfers, or unauthorized accounts.
- Misrepresent model outputs as human-authored, verified, or guaranteed facts where that would be deceptive or harmful.
Violations may result in throttling, key revocation, suspension, balance withholding, account termination, or reporting to payment providers or authorities where appropriate.
8. AI Outputs and User Content
You are responsible for the prompts, files, images, instructions, and other content you submit through cuberout, and for how you use model outputs. AI outputs may be inaccurate, incomplete, unsafe, offensive, or unsuitable for your intended use.
You should independently review outputs before relying on them, especially for legal, medical, financial, safety, employment, education, or other high-impact decisions.
9. Data and Privacy
cuberout does not intentionally store prompt or model response bodies in its application database. It does store account, API key metadata, wallet, ledger, payment, usage, request status, model, token count, latency, and error metadata needed for billing, security, abuse prevention, service operation, and support.
API traffic is forwarded to upstream routing services and model providers as needed to fulfill requests. Please review the Privacy Policy for more details.
10. Suspension and Termination
cuberout may suspend or terminate access if you violate these Terms, create security or abuse risk, fail to maintain a usable prepaid balance, initiate fraudulent or reversed payments, or request account deletion.
On termination, API keys may be revoked and service access may end. cuberout may retain records where needed for tax, accounting, fraud prevention, security, dispute resolution, legal compliance, or legitimate business purposes.
11. Disclaimer of Warranties
The service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, or reliability.
12. Limitation of Liability
To the maximum extent permitted by applicable law, cuberout and its operators are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, reputation, business opportunity, or model output value.
To the maximum extent permitted by applicable law, cuberout's total cumulative liability for claims arising from or related to the service is limited to the amount you paid to cuberout during the three months before the claim arose.
13. Changes to These Terms
cuberout may update these Terms from time to time. The updated date above will change when updates are published. Material changes may be announced through the bot, service notices, documentation, or another reasonable channel. Continued use after changes take effect constitutes acceptance of the updated Terms.
14. Governing Law and Disputes
These Terms are governed by applicable law, excluding conflict-of-law rules. The parties will first try to resolve disputes in good faith. If a dispute cannot be resolved informally, it will be handled by the competent courts or other dispute forum available under applicable law.
